Last  Will  and  Testament of
Fernandes  Rhoades


          I,  Fernandes Rhoades, of Shelby County, Indiana, do make and publish, this, my last will and testament, hereby revoking all former wills by me made.

          Item, I, It is my will and I direct, that all my just debts including the expenses of my last sickness and funeral expenses be paid.

          Item, II, I will and bequest all my personal property of every kind and character, to my beloved wife, Hester. A. Rhoades, to be held by her absolutely.

          Item, III, I will and devise to my beloved wife, Hester A. Rhoades, to be held by her absolutely in fee-simple, all of the real estate of which I may die seized.

          Item, IV, I hereby appoint my beloved wife, Hester A. Rhoades, executrix of this my last will and testament, and request that she retain the firm of  Meeks and Hack to act as her attorneys in the settlement of my estate.

          In witness whereof, I have hereunto set my hand and seal, at Shelbyville, Indiana, this 16th day of August, 1910.

The foregoing will was signed, sealed and acknowledged by the said Fernandes Rhoades, in our presence and was declared by him to be his last will and testament, and, at his request, and in his presence, and in the presence of each other, we now subscribe our names hereto as witnesses, this 16th day of August, A.D. 1910.

State of Indiana, Shelby Co, SS:

          Be it remembered, that on the 25th day of April, 1911, Thomas W. Flemming, one of the subscribing witnesses to the within and foregoing last will and testament of Fernandes Rhoades, late of said County, deceased, personally appeared before Otto L. Coyle of the circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath, declared and testified as follows, that is to say: That on the 16th day of August, 1910, he saw the said Fernandes Rhoades sign his name to the said instrument, in writing, as and for his last will and testament, and that the same instrument in writing was, at the same time, at the request of said Fernandes Rhoades and with his consent, attested and subscribed by the said Thomas W. Flemming and Charles A. Hack, in the presence of said Testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Fernandes Rhoades was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age, that is (more than twenty-two years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deposed verify believes, and further said deponent says not.

          I, Otto L. Coyle, Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within annexed Will and Testament of Fernandes Rhoades has been duly admitted to Probate, and duly approved by the Testimony of  Thomas W. Flemming our subscribing witness thereto, that a complete record of said Will, and of the testimony of said Thomas W. Flemming in proof thereof, has been by me duly made and recorded in Book 6(?) at pages 17 and 18 of the record of Wills of said county.
          In testimony whereof, I have hereunto subscribed my Name, and affixed the seal of said Court, at Shelbyville, this 25th day of April, 1911.
