          This Indenture made this twenty eighth day of August A. D. 1851 between  Cyrus Wright  as Commissioner of the Circuit Court of the County of Shelby in the State of Indiana of the one part and  William Halstead  of said County of the other part Witnesseth that whereas the said William Halstead on the thirteenth day of March in the year 1851 filed in the office of the Clerk of the Circuit Court of said County of Shelby and state of Indiana his Bill of complaint and making parties defendant thereto  Henry Hinds,  Abigail Weter,  Henry Melarkey,  John Melarkey, Margaret Mosin,  Daniel Mosine,  Rosannah Melarkey,  Thomas Melarkey,  George Hinds,  Michael Hinds,  Henry F Hines,  William Kaster, Margaret Kaster,  William Bailey, Nancy Bailey,  James Robins,  Elizabeth Robins,  Jacob Hinds,  Daniel T Hinds,  William Hinds,  George Hinds Jr,  James Hinds,  William H Hinds  and  Elizabeth Echerson  who were the heirs at law of  Jacob A Hinds  late of Shelby County and thence deceased upon which said bill of complaint such proceedings were had that afterwards at a time of said court held at the Court House in Shelbyville in said County on the 18th day of August in the year 1851 and on the tenth Judicial day of said term said cause came to a hearing upon which said Court did then and there find the equity of said case to be with said complainant and that the contract between the said complainant and the said Jacob A. Hinds deceased as stated and set fourth in the said bill ought to be specially performed and that said complainant William Halstead was fully entitled to a good and sufficient deed of conveyance in fee simple for the lots and parcels of land described in said bill     Whereupon said Court thence and there ordered adjudged and decreed that all the estate right title interest and claim of the said defendants either in law or equity of in and to lots numbered twenty nine (29) and forty four (44) in the town of Marion in said County should rest absolutely in fee simple in said William Halstead his heirs and assigns forever as fully as the same were had and held by the said Jacob A Hinds decd in his lifetime and at the time of his death   It would further ordered and decreed by said Court that the said Cyrus Wright should be a commissioner of said Court to make execute and deliver to said Halstead a good and sufficient deed of conveyance in fee simple for said lots and parcels of land and to report his side proceedings therein at the said term of said Court all of which said proceedings remain of record in said Court as by a reference thereto will more fully appear     Now therefore in consideration of the premises and by virture of the order and decree of said Circuit Court made as aforesaid the said Cyrus Wright as the commissioner of said Court as aforesaid has granted conveyed and confirmed and does by these presents grant convey and confirm unto the said William Halstead his heirs and assigns forever all the following described lots and parcels of land to wit
lots numbered twenty nine and forty four in the Town of Marion in the County of Shelby and State of Indiana with all the rights privileges and appurtenances thereunto belonging and all the reversions remainders and profits thereof and all the estate right title interest and claim of the defendants in said bill of complaint made and each and every of them in and to the same       To have and to hold the said premises with the appurtenances to the sole and only proper use benefit and behoof of the said William Halstead his heirs and assigns forever       In witness whereof the said Cyrus Wright as Commissioner as aforesaid his here unto set his hand and seal the day and year first above written
